1. Scope and Terms of Use

  • These Terms and Conditions govern the contractual relationships between MrBrunch AG, Unterrohrstrasse 3, 8952 Schlieren (hereinafter "Seller") and its customers (hereinafter "Buyer") for all online orders placed via mrbrunch.ch as well as for subscriptions, quote and catering orders, gift voucher purchases and the provision of rental items.
  • Deviating conditions of the buyer only apply if they have been confirmed in writing by the seller.
  • The Terms and Conditions apply to both private consumers and business customers.
  • Changes and additions to the Terms and Conditions are possible at any time. The version valid at the time of purchase shall apply.
  • Buyers are obliged to provide truthful and complete information in the ordering process.
  • Delivery area is Switzerland. For orders from abroad, an individual inquiry is necessary.
  • The imprint applies in addition.

2. Subject Matter of the Contract

  • The subject matter of the contract are the products ordered via mrbrunch.ch, in particular brunch boxes and other food products, gift vouchers, recurring deliveries under subscriptions, and catering services including any rental items as specified in the quote.
  • Images on the website may differ from the original product.
  • Product images are for illustration purposes only and are not binding.

3. Formation of the Contract

  • The buyer selects products in the online shop and places them in the shopping cart.
  • By clicking on "Proceed to Checkout" and completing the order, the buyer makes a binding purchase offer.
  • When paying by credit card or TWINT, the payment method is charged as part of completing the order; the order is only created after successful payment.
  • The contract is concluded with the sending of the order confirmation by e-mail.
  • The seller reserves the right to withdraw from the contract even after conclusion of the contract, e.g. in case of unavailability or incorrect information. Any payments already made will be refunded in this case.

4. Storage of the Contract Text / Registration

  • The order and the entered data (name, address, e-mail etc.) are stored.
  • Buyers can voluntarily register as customers.

5. Prices

  • The prices displayed in the online shop at the time of ordering apply, in Swiss francs (CHF) including statutory VAT, excluding delivery costs.
  • Delivery costs depend on the delivery zone (postal code) and are displayed during the ordering process before the order is completed. Depending on the delivery zone, a minimum order value may apply or delivery may be free of charge above a certain order value.
  • Surcharges may apply for special delivery time slots; these are shown during the ordering process.
  • Price changes and errors are reserved.

6. Payment Terms

  • Accepted payment methods in the online shop: credit card (e.g. VISA, Mastercard) and TWINT.
  • Business customers with a company account can additionally purchase on account. Invoices are payable within 30 days of the invoice date without deduction.
  • Payment processing by credit card and TWINT is handled by an external payment service provider.

7. Delivery Terms

  • Orders must be placed by the displayed order deadline, generally by 4:00 pm on the day before delivery. The order deadlines displayed in the online shop are decisive; individual products may have different deadlines.
  • Delivery is only made within Switzerland to addresses in the active delivery zones. The online shop shows whether a delivery address can be served when the postal code is entered. Exceptions only on request.
  • In case of unavailability, the buyer will be contacted and will receive his money back.
  • Delivery is at the seller's risk.
  • The buyer is obliged to be available at the delivery time. In case of absence, the box will be deposited in front of the front door, the delivery is thus considered to have taken place.
  • For special instructions, the comment field in the ordering process can be used or info@mrbrunch.ch can be contacted.

8. Cancellations and Changes

  • Orders can be cancelled directly in the customer account until the order deadline (section 7), provided the order has not yet been prepared for delivery, the order value is below CHF 300.00 and the order does not contain any gift vouchers.
  • In all other cases, and for changes to an order, the seller must be contacted as early as possible by e-mail at info@mrbrunch.ch.
  • In the event of a cancellation, the amount paid will be refunded to the payment method originally used. Depending on the payment provider, the credit may take a few business days.
  • After the order deadline, cancellation is excluded (see section 9).

9. Warranty and Complaints

  • There is no statutory right of withdrawal under Swiss law. Since our brunch boxes are fresh food products that are individually assembled and can spoil quickly, withdrawal after placing an order is excluded.
  • If a product is defective or spoiled or if there is an incorrect delivery, the complaint must be reported within 24 hours of receiving the delivery, preferably directly via the complaint form in the customer account (section "Complaints") or by e-mail to info@mrbrunch.ch with photo evidence.
  • In such a case, we will examine the complaint individually and offer - depending on the situation - a replacement delivery or refund.
  • The buyer is obliged to check the delivery immediately upon receipt. Complaints after the expiry of the 24-hour period can no longer be taken into account.

10. Vouchers and Discount Codes

  • Gift vouchers are valid from the date of issue for the period stated on the voucher, generally five years.
  • Vouchers can be redeemed in several partial amounts; any remaining balance is retained until the voucher expires.
  • Vouchers are transferable but cannot be exchanged for cash. Cash payment, including of remaining balances, is excluded.
  • Discount codes (promotional codes) may be limited in time, limited in the number of redemptions or linked to a specific person or e-mail address. They cannot be redeemed for cash and cannot be extended or transferred retrospectively.
  • The purchase of gift vouchers is excluded from online cancellation (section 8).

11. Subscriptions

  • Under a subscription, the seller delivers the agreed products on a recurring basis at the selected interval (e.g. weekly, every two weeks or monthly).
  • Subscription deliveries are billed by invoice.
  • The buyer can pause the subscription, skip individual deliveries or cancel the subscription at any time in the customer account. No notice periods apply.
  • The order for an upcoming delivery is created automatically on the day before delivery. Orders already created are subject to the cancellation rules in section 8.
  • Minimum order quantities may apply to individual products; these are displayed in the online shop.
  • The agreed subscription prices or the current catalogue prices apply. The buyer will be notified of price changes in advance.

12. Quotes, Catering and Business Customers

  • For catering events, larger orders and special products, the seller prepares a quote on request. The quote is valid until the date stated therein; after that, it ceases to be binding.
  • Upon acceptance of the quote by the buyer, it is reviewed and confirmed by the seller. The contract is concluded with the seller's order confirmation.
  • Individual items of a quote may be billed according to actual consumption (e.g. beverages). The billing method indicated in the quote is decisive; billing takes place after the event.
  • Business customers can maintain a company account. On request and after approval by the seller, billing is carried out via collective invoice in monthly, quarterly or yearly billing periods.
  • Invoices to business customers are payable within 30 days of the invoice date without deduction.

13. Rental Items

  • Rental items (e.g. dishware, cutlery or equipment) are provided exclusively as part of quote or catering orders.
  • The rental items remain the property of the seller and must be returned after the event in full and in the agreed condition as specified in the quote.
  • Missing, damaged or unusable rental items will be invoiced to the buyer at their replacement value.

14. Disclaimer

  • The seller is not liable for damages caused by slight negligence - insofar as legally permissible. Liability for gross negligence or intentional behavior remains unaffected.
  • Any liability for indirect damages, consequential damages or lost profit is excluded.
  • The seller is not liable for any health complaints or food intolerances that arise from the consumption of the delivered products. The buyer is obliged to check independently before ordering whether he can tolerate the ingredients contained.
  • In case of complaints due to the perishability of individual products, the respective manufacturer should be contacted directly. The seller provides the relevant information on request.
  • The seller assumes no liability for technical disruptions during the ordering process or for the permanent availability of the website and online shop.

15. Data Protection

  • Data is treated confidentially and only used within the framework of legal regulations.
  • Details on the processing of personal data, the use of cookies and the service providers involved are set out in our privacy policy at mrbrunch.ch/en/privacy-policy.

16. Copyright

  • All images and content on mrbrunch.ch are protected by copyright. Use by third parties is only permitted with written consent.

17. Final Provisions

  • Swiss law applies exclusively (excluding the UN Sales Law).
  • The place of jurisdiction is the registered office of the seller in Schlieren, Switzerland.
  • If a clause of these Terms and Conditions is invalid, the remaining provisions shall remain valid.
